The terms and conditions in this WarAuction.com User Agreement and in the attached Exhibits (collectively, the "Terms") are the terms and conditions on which WarAuction.com is willing to provide you access to the Site and the Services. You must agree to the Terms to have access to the Services. If you do not agree to be bound by the Terms, click the second box at the end of the Terms and exit. 

Description of Service:  WarAuction.com is an auction venue that enables sellers to list hunting and sporting collectibles for sale and buyers to bid on such items.  Sellers can choose a variety of pricing formats and auction styles to sell merchandise.  The Owner is not involved in the actual transaction between either parties.  We have no control over the truth of descriptions of items and do not guarantee the quality, safety or legality of items offered for sale.  We cannot ensure whether a seller has abilities to sell said items or if buyer is able to buy such item.   We do not ensure that a buyer and seller will complete a transaction.  WarAuction.com (the “Site”) is providing you (the “User”) access to its services.    

User Conduct: You must comply with all policies and procedures posted on the Site, and WarAuction.com may change those policies and procedures from time to time. You shall not post or store on the Site any software, information, data, databases, music, audio, video or audio-visual files, photographs, images, documents text, digital files or other material (collectively, "Material") which: (a) violates or infringes anyone's intellectual property rights, including copyrights, trademarks, service marks, trade secrets, patents or publicity rights; (b) violates federal, state or local law; (c) is obscene, pornographic, defamatory, racist, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable; (d) is false, inaccurate or misleading; (e) is fraudulent or involves the sale of counterfeit or stolen items; (f) contains any viruses, Trojan horses, worms, time bombs, cancelbots, Easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; or (g) imposes a large load on the Site or WarAuction.com’s’ system. Bidding:  Winning buyers and sellers are obligated to complete the transaction. Each participant acknowledges that a "winning" bid must be an amount greater than any reserve established by the seller. By bidding on an item, you agree to be bound by the conditions of sale included in the item's description so long as those conditions of sale are not in violation of the Terms and are not unlawful. A bidder may not withdraw a bid unless WarAuction.com determines, in its sole discretion, that exceptional circumstances exist. Bidders shall not directly or indirectly manipulate the price of any item listed for sale. Each bidder on an item certifies that he or she has the legal right to buy the particular item.   

Listing and Selling:  Each Seller should carefully consider whether you want to place an item for auction. Your opening bid must be the minimum bid that you would accept. Listings may only include descriptions, graphics and pictures which you supply the Site, which describes the item for sale. Sellers must be aware when listing to not infringe upon the copyright, trademark or other rights of those third parties. Each seller certifies that he or she has the legal right to sell, and will sell, the particular item listed free and clear of all liens, claims and encumbrances. No seller shall directly or indirectly manipulate the price of any of item listed for sale.   Sale of your item(s) on this Site should not (a) violate any law, statute, ordinance or regulation (b) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (c) be obscene or be otherwise harmful to minors; (d) contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (e) cause us to lose, in whole or in part, the services of our ISP's or other suppliers; (f) contain advertising banners, graphics or material for any other website or business which may sell the same or similar product . Listings should also not link directly to (g) goods or services that have been up for auction at a lower price than what your items’ reserve or minimum bid amount (h) are simultaneously listed for auction on a web site other than this one.  Each seller agrees that WarAuction.com may take any appropriate action, in its sole discretion, to modify, limit or terminate the information provided in any listing.   

Prohibited Items:  The items listed on the Prohibited Items List are strictly prohibited for sale on the Site. You may not offer any item for sale that is prohibited by federal, state or local law. We may, in our sole discretion, remove any item from the Site that we deem unacceptable, even if the item is not listed on the Prohibited Items List or its sale is not unlawful.

Feedback Center:  WarAuction.com has instituted a feedback system to help participants obtain information on prospective sellers and buyers.WarAuction.com does not control the information posted in the Feedback Center and cannot guarantee its accuracy or reliability. You agree not to manipulate the Feedback Center. Manipulation includes directly or indirectly creating positive feedback for you, leaving negative feedback for others under secondary accounts or third parties, or leaving unwarranted negative feedback for others.

Privacy Policy:  WarAuction.com is sensitive to privacy issues with respect to the use of information provided to us over the Internet by users of our web site. Generally, you can visit this web site without telling us who you are or revealing personal information about yourself. Unless you give us your permission, we will not share with anyone other than WarAuction.com and its affiliates any personal information you provide to us.

Only essential information will be shared with other users of this site for the completion of transactions or for questions about a specific item.  Notification of changes in our privacy policy will be posted on our site. The Terms and any obligations between WarAuction.com and you shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions. You may not assign your rights or obligations under this Agreement without the prior written consent of WarAuction.com, and any attempted assignment without that consent shall be void.
